The processing of personal data can be based on various legal grounds. If we need your data to fulfill a contract with you or to respond to inquiries from you regarding a contract, the legal basis for this data processing is Article 6(1) sentence 1 lit. b GDPR. If we obtain your consent for a specific data processing, the legal basis is Article 6(1) sentence 1 lit. a GDPR. Some data processing activities are carried out based on our legitimate interest, with a balancing of your protected interests and our legitimate interests. The legal basis here is Article 6(1) sentence 1 lit. f GDPR. If the processing is necessary to fulfill a legal obligation to which we are subject, the legal basis is Article 6(1) sentence 1 lit. c GDPR.

We have implemented extensive technical and organizational safeguards to protect your data from accidental or intentional manipulation, loss, destruction, or unauthorized access. Our security procedures are regularly reviewed and adapted to technological advancements. Additionally, our employees have been trained in the data protection and confidential handling of personal data.

Through SSL encryption (Secure Sockets Layer) on our website, data exchange between the visitor's browser and our server occurs over a secure connection. The secure connection is indicated by the prefix HTTPS (Hypertext Transfer Protocol Secure).

Data Transfer

In principle, we do not transfer your personal data to third parties unless we are legally obligated to do so, or the data transfer is necessary for the execution of the contractual relationship, or you have expressly consented to the transfer of your data.

External service providers and partner companies, such as payment service providers or IT service providers, receive your data only to the extent necessary. The respective service provider is responsible for the content of external services, though we conduct a review of the services for compliance with legal requirements to the extent feasible.

We strive to process your data within the EU / EEA. However, it may occur that we use service providers who process data outside the EU / EEA. In such cases, we ensure that an adequate level of data protection comparable to EU standards is established with the recipient before transferring your personal data. This can be achieved, for example, through EU Standard Contractual Clauses, Binding Corporate Rules, or special agreements to which the company subscribes.

Data Processing When Visiting the Website

When you use the website for informational purposes only, that is, if you do not register or transmit information to us in any other way (e.g., via a contact form), we collect the following technical information (logfile data):

The collection of this data is technically necessary to display our website to you and to ensure stability and security. We (and our service provider) generally do not know who is behind an IP address. We do not combine the above-mentioned data with other data.

The legal basis is Article 6(1) sentence 1 lit. f GDPR; insofar as an access to information stored on the end device of the user is absolutely necessary, also § 25 Abs. 2 No. 2 TDDDG.

Since the collection of data for providing the website and storage in logfiles is essential for operating the website and protecting against misuse, our legitimate interest in data processing prevails in this case.

When you contact us via email or through a contact form, the data you provide (your email address, and possibly your name and phone number) is stored by us to answer your questions and process your requests. The legal basis for this is Article 6(1) sentence 1 lit. f GDPR.

If we request information via our contact form that is not necessary for contacting you, we always mark this information as optional. This data helps us to specify your request and to improve the handling of your concern. Providing this information is done voluntarily and with your consent, Article 6(1) sentence 1 lit. a GDPR. If the information includes communication channels (e.g., email address, phone number), you also consent to us contacting you via these communication channels to respond to your request. You can, of course, withdraw this consent at any time for the future.

Your data obtained during the contact process will be deleted as soon as they are no longer needed to achieve the purpose of their collection, your request has been fully processed, and no further communication with you is required or desired.

As the data controller, our company has implemented numerous technical and organizational measures to ensure the most comprehensive protection of personal data processed through this website. However, internet-based data transmissions can generally have security gaps. Absolute protection cannot be guaranteed; in particular, the sending of unencrypted emails is not secure. We therefore request that you do not send sensitive data via unencrypted email, but use encrypted communication channels or postal services instead.

Newsletter

Subscribe to Newsletter

With our email newsletter, we inform you about us and our global work. 
For subscribing to our newsletters, we use the so-called double opt-in procedure. This means that after your registration, we will send you an email to the provided email address, asking you to confirm that you wish to receive the newsletter. 

The legal basis for sending the respective newsletter is your consent according to Article 6(1) sentence 1 lit. a GDPR in conjunction with § 7(2) No. 3 UWG or the legal permission according to § 7(3) UWG.
Your consent is voluntary, and you can withdraw it at any time with effect for the future, e.g., by clicking on the unsubscribe link at the end of each newsletter email or by sending an email to datenschutz@aktiongegendenhunger.de.

The only mandatory information for sending the newsletter is your email address. Providing additional data is voluntary: This data is used to address you personally. After your confirmation, we will store your email address for the purpose of sending the newsletter until you withdraw your consent. We will also store your current IP address at the time of registration, the time of registration, and the confirmation, as well as, if provided by you, your first and last name, for up to three years after registration (statute of limitations). The purpose of this procedure is to prove your registration in case of doubt and to clarify any misuse of your personal data. The legal basis for logging the registration is our legitimate interest according to Article 6(1) sentence 1 lit. f GDPR in proving a previously given consent, also see Article 7(1) GDPR. 

ActiveCampaign

The newsletter is sent using "ActiveCampaign", a newsletter distribution platform based at 1 N Dearborn, 5th Floor, Chicago, IL 60601, United States. The email addresses of our newsletter recipients, as well as other data described in these notices, are stored on ActiveCampaign's servers in the USA. ActiveCampaign uses this information to send and analyze the newsletters on our behalf. Furthermore, we have entered into a data processing agreement with ActiveCampaign. This is a contract in which ActiveCampaign agrees to protect our users' data and specifically not to disclose it to third parties.
 
We would like to point out that ActiveCampaign is a US-based service provider. The USA does not have a data protection level comparable to the EU, which means that users may find it difficult to assert data protection rights against the US provider and to navigate the US legal system. For data transfers to third countries, we place a high value on complying with the specific guarantees under Articles 44 et seq. GDPR. Therefore, we have entered into standard contractual clauses with the provider to offer our newsletter recipients a high level of data protection.

Newsletter Tracking

Please note that when sending the newsletter, we analyze your user behavior to determine whether and when the newsletter has been opened. For this analysis, the sent emails contain so-called web beacons or tracking pixels, which are stored on our server and are loaded when the newsletter is opened. Technical information such as browser type, time of opening, and IP address is transmitted. For the analysis, we link the mentioned data and web beacons with your email address and an individual ID. Links in the newsletter also contain this ID and allow us to analyze your click behavior.

With the data obtained in this way, we create a user profile to tailor the newsletter to your individual interests. We track when you read our newsletters, which links you click on, and infer your personal interests. We also link this data with actions you have taken on our website. The legal basis for this data processing is your consent, Article 6(1) sentence 1 lit. a GDPR.

You can withdraw your consent at any time with effect for the future. In this case, the withdrawal applies to the entire newsletter, as a separate withdrawal of tracking is unfortunately not technically possible. To do this, simply click on the unsubscribe link provided in each email.

Such tracking is also not possible if you have disabled the display of images by default in your email program. In this case, the newsletter will not be fully displayed, and you may not be able to use all functions. If you manually display the images, the above-mentioned tracking will occur.

The information from tracking is stored as long as you are subscribed to the newsletter. After unsubscribing, the data is anonymized and used for purely statistical purposes.

The data you provided for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter and deleted after you cancel the newsletter. Data stored for other purposes remains unaffected.

Informing Donors via Newsletter

With the newsletter, we inform you about us and our global work. With your donation, you will receive our newsletter to the email address you provided with the donation without further action on your part. The legal basis for sending the newsletter is our legitimate interest according to Article 6(1) sentence 1 lit. f GDPR. Our legitimate interest is in timely communication and supporting many people suffering from hunger, whom we want to raise awareness for. If you no longer wish to receive the newsletter, you can object to the receipt and processing of data for the purpose of sending the newsletter at any time by clicking on the unsubscribe link at the bottom of each newsletter or by sending an email to datenschutz@aktiongegendenhunger.de.

We store your email address, your IP address, the date and time of the donation or unsubscription, and, if provided, your first and last name, for up to three years after registration. The purpose of this procedure is to prove your registration in case of doubt and to clarify any misuse of your personal data. The legal basis for logging the registration is our legitimate interest according to Article 6(1) sentence 1 lit. f GDPR in having proof and being able to clarify misuse.
 
The newsletter is sent using "ActiveCampaign". For more information about the distribution tool, please refer to the section "ActiveCampaign".

Promotional emails from third parties

For the distribution of advertising, we also use partners who send our designed advertising materials to their own recipient lists via email. In this case, the email addresses and possibly other information are only known to the respective service provider. We do not have access to this information, and Aktion gegen den Hunger never has access to or insight into the recipient lists of the advertising partners. Please contact the partner from whom you received the email with any questions. We are also happy to assist and forward your inquiries to the relevant partner, provided we can identify which service provider your inquiry pertains to.

Online Donations

If you would like to support the work of Action Against Hunger with a one-time or recurring donation, you can do so through our online donation form.

For this purpose, we process the personal data required to conclude and fulfill the donation contract: your title, first name, last name, email address, and postal address.

The data will be stored for the duration of the donation contract and according to legal obligations.
 
For payment processing, we use various payment service providers, which are always clearly identified and accept your entries. These service providers are therefore recipients of the personal data collected in connection with the payment process. You make the decision regarding the payment service provider.

We would like to point out that for providers outside the EU and EEA, it cannot be ruled out that your personal data may be transferred to a third country that does not have the same level of data protection as the EU and EEA. When data is processed outside the EEA, where there is no data protection standard equivalent to the European one, we have entered into EU standard contractual clauses with the service provider to ensure a high level of data protection.

Depending on the payment method you choose, your data will be forwarded to the respective financial service provider:

When you donate via our website, we collect your email address and name to send you a confirmation email about your donation and to address any questions you may have regarding the processing of your donation.

For our donation form, we use Fundraisingbox, a tool from Wikando GmbH, Schießgrabenstraße 32, 86150 Augsburg. When you donate via the donation form, various data is collected from you, which we process solely for the purpose of handling your payment/donation and issuing a donation receipt. Depending on the selected payment method, your data is forwarded by Fundraisingbox to the respective payment service provider. The legal basis for the described data processing in connection with online donations and for forwarding data to payment service providers is the necessity of data processing for the conclusion and fulfillment of a contract according to Art. 6 para. 1 sentence 1 lit. b DSGVO.

As a non-profit organization, we also use your email address to efficiently, quickly, and resource-conservingly inform you about the use of your donations, our work worldwide, and current aid projects by Action Against Hunger. Further information can be found under the section Newsletter “Informing Donors via Newsletter”.

The legal basis is thus our legitimate interest according to Art. 6 para. 1 sentence 1 lit. f DSGVO. Our legitimate interest lies in timely communication and in supporting many people suffering from hunger, whom we aim to make aware of.

Of course, you can object to the use of your email address for donation advertising purposes at any time. You can do this by clicking on the link provided in each informational email. Participation in Campaigns and Petitions

Personal Data: Action Against Hunger allows participation in campaigns and petitions on the website. Personal data of supporters is collected and processed during this process. Action Against Hunger only processes the data that has been entered by the supporters themselves. Data that is required for participation is marked with an asterisk (*). Providing additional data is voluntary. Supporters of a campaign or petition must provide their full name, complete address, and a valid email address in addition to their signature. To stay informed about the campaign or petition, providing an email address is also a prerequisite. Supporter data is never publicly visible on the website or accessible to search engines.

Data Processing: The data entered by supporters is processed by Action Against Hunger for conducting the campaign or petition, informing about the progress, and documenting the participation of supporters. Depending on the target of the campaign or petition, the supporters' data may also be forwarded to political and economic decision-makers or other recipients of the respective campaign or petition. This will be specified in the respective campaign or petition.

The legal basis for data processing is the necessity for fulfilling a contract according to Art. 6 para. 1 sentence 1 lit. b GDPR.

Exclusion and Deletion of Data: Participation in our campaigns and petitions is voluntary. Failure to provide required (asterisk-marked) data will unfortunately exclude participation. The collected and processed personal data related to a campaign or petition will be stored for a period of three years (from the end of the year in which the campaign or petition took place). After that, the data will be automatically deleted.

Applications

You can apply to our company electronically, for example via email or web form. Please note that unencrypted emails are not transmitted securely.

Your details will be used to process your application and decide on the establishment of an employment relationship. The legal basis is § 26 para. 1 in conjunction with para. 8 sentence 2 BDSG. Furthermore, your personal data may be processed to defend against any legal claims arising from the application process. The legal basis for this is Art. 6 para. 1 sentence 1 lit. f GDPR. The specified purposes also include the legitimate interest in processing.

If an employment relationship is established between you and us, we may, according to § 26 para. 1 BDSG, continue to process the personal data already received from you for purposes of the employment relationship if this is necessary for the execution or termination of the employment relationship or for exercising or fulfilling rights and obligations arising from laws, collective agreements, or company agreements.

No further processing of your application data beyond the described use will take place.

Your personal data will be deleted after the completion of the application process, but no later than 6 months, unless there are other legitimate interests on our part that prevent deletion or you have given us consent for longer storage. An example of another legitimate interest is a duty to provide evidence in a procedure under the General Equal Treatment Act (AGG).

The USA is currently considered a third country from a data protection perspective. You do not have the same rights there as within the EU/EEA. Storage Duration

Data sent by us and associated with cookies will be automatically deleted after 14 months. Deletion of data that has reached the retention period occurs automatically once a month.

Facebook Custom Audiences (Facebook Pixel)

We use the Custom Audiences service of Meta Platforms, Inc., 1601 S. California Avenue, Palo Alto, CA 94304, USA (hereinafter referred to as "Facebook") for usage-based online advertising.

For this purpose, we create target audiences in Facebook Ads Manager based on specific characteristics, and ads are displayed within the Facebook network to these users. In principle, a non-reversible and non-personalized checksum (hash value) is generated from your usage data and transmitted to Facebook for analysis and marketing purposes. For geographical targeting of ads, your IP address is also stored and used.
